Fermenterie BIONIC® — MealMe Sàrl
These General Terms and Conditions of Sale (hereinafter “GTC”) cancel and replace any previous version published on the fermenterie-bionic.ch website or communicated previously.
1. Scope
These GTC apply to any order placed on the fermenterie-bionic.ch website, operated by MealMe Sàrl under the Fermenterie BIONIC® brand.
They govern the online sale of BIONIC products to customers in Switzerland, mainly private individuals. Professional orders — resale, restaurants, catering, events, institutions or bespoke production — may be subject to specific conditions, a quote or a separate agreement (see art. 10).
By placing an order, the customer confirms having read, understood and accepted these GTC.

3. Products
BIONIC sells Swiss lacto-fermented vegetables, unpasteurised, kept chilled and intended for human consumption.
The products are presented on the website with their essential characteristics: recipe, ingredients, format, price, storage information and, where available, nutritional information.
Visuals, texts and photographs are provided for guidance and may vary slightly depending on the batch, season, raw materials, format or packaging. These variations do not affect the conformity of the product as long as its essential characteristics are respected.
BIONIC products are foodstuffs. They are neither food supplements, nor medicines, nor medical devices, nor therapeutic products. The information published has a food, culinary and informational purpose; it does not constitute medical, individualised nutritional or therapeutic advice.
The products are intended for human consumption and are not formulated as animal food.
4. Availability
Offers are valid as long as they are visible on the website and within the limits of available stock. BIONIC may modify, suspend or withdraw any product or offer at any time, without effect on orders already confirmed.
If a product becomes unavailable after an order is validated, BIONIC informs the customer as soon as possible and offers, depending on the case, a replacement, a credit note, a postponed dispatch or a refund.
5. Order
The customer selects their products, checks their basket, enters the billing and delivery information, then validates their order through payment.
Before validation, the customer must check the accuracy of their order, email address, delivery address and contact details. BIONIC cannot be held responsible for a delay or impossibility of delivery resulting from incorrect, incomplete or outdated information provided by the customer.
A confirmation is sent by email after payment. The sales contract is concluded when the order is confirmed by BIONIC.
BIONIC reserves the right to refuse or cancel an order in the event of an obvious error, suspected fraud, abuse, unavailability, impossibility of delivery, non-payment or behaviour contrary to these GTC.
6. Prices
Prices are shown in Swiss francs (CHF). Unless otherwise stated, they include any applicable taxes. Delivery charges are shown separately before the order is validated.
As at the date of these GTC, the B2C delivery charges shown on the site are as follows:
- 13.50 CHF for orders up to 79.95 CHF;
- free delivery from CHF 80.
BIONIC may change its prices and delivery charges at any time. The applicable prices and charges are those shown at the time the order is validated.
7. Payment
Payment is made by the means offered at the time of the order, in particular bank card or TWINT. Payments are processed by secure providers, in particular Stripe; BIONIC does not store complete bank card data on its own servers.
The order is only prepared after the payment has been effectively validated. In the event of payment refusal, failed authorisation, payment cancellation or suspected fraud, BIONIC may suspend or cancel the order.
8. Subscriptions and recurring offers
Certain offers may be proposed as a subscription, routine or recurring offer. Their specific conditions — price, duration, frequency, delivery terms, accepted payment method, renewal and cancellation — are shown on the offer page or during the ordering process.
Where a recurring payment is offered, it is made by bank card via the indicated provider; TWINT may not be available for recurring payments.
In the event of a contradiction between these GTC and the specific conditions expressly displayed for a subscription offer, the latter prevail for the subscription concerned.
9. B2C delivery
BIONIC currently delivers within Switzerland.
B2C orders are shipped in insulated packaging suited to the nature of the products. Unless otherwise stated, B2C delivery is not an actively refrigerated delivery.
The indicative delivery time is 5 to 7 working days from validation of the order, subject to stock, preparation days, public holidays, logistical constraints, weather conditions and any carrier delays.
Times are given for guidance. A reasonable delay does not automatically give rise to a cancellation, compensation or refund, except where mandatory provisions state otherwise.
On receipt, the customer must place the products in the fridge as soon as possible and follow the instructions on the packaging.
10. B2B delivery and professional orders
Professional orders — resale, restaurants, catering, events, institutions, large volumes or bespoke production — are organised by direct contact with BIONIC.
They may be subject to a quote, a minimum order, a deposit, a production lead time, specific delivery conditions, a refrigerated delivery, cancellation conditions, a recipe or label validation, a technical sheet or per-batch traceability.
For B2B orders, the specific conditions agreed in writing (quote, offer or contract) prevail over these GTC in the event of a contradiction.
Unless otherwise agreed, the professional customer is responsible for maintaining the cold chain, the storage conditions, the handling, any processing and the resale of the products after their handover or delivery.
11. Receipt of the order
The customer must check their order immediately on receipt.
In the event of a damaged, missing, clearly non-conforming product or one with a visible defect, the customer must contact BIONIC promptly, ideally within 48 hours of receipt, at contact@fermenterie-bionic.ch, indicating:
- the order number;
- a clear description of the problem;
- photographs of the parcel, the packaging, the label and the product concerned;
- any information useful for examining the situation.
BIONIC examines each case and offers, depending on the situation, a replacement, a credit note, a full or partial refund, or another appropriate solution. Defects not visible on receipt must be reported as soon as they are discovered.
12. Returns and no convenience right of withdrawal
For reasons of food safety, quality and preservation, food products cannot be taken back once shipped.
No convenience return is accepted for BIONIC food products, in particular in the event of a change of mind, an ordering error attributable to the customer, absence at delivery, a delay in collecting the parcel or failure to comply with the storage conditions after receipt.
This rule does not limit the customer's rights in the event of an actually defective product, one damaged on receipt or non-conforming (see art. 11 and 17).
A cancellation can be accepted only if the order has not yet been prepared, handed to the carrier or shipped. BIONIC remains free to accept or refuse a cancellation request depending on the progress of the order.
13. Storage and use of the products
BIONIC products are unpasteurised and must be kept refrigerated.
The customer must follow the instructions on the packaging, in particular the date shown, the storage conditions and any instructions specific to the batch or format.
Once opened, the products must be carefully resealed, kept refrigerated and consumed within the month, with the vegetables remaining well submerged in their brine.
The products must not be consumed if the packaging is abnormally swollen, pierced or damaged, if the appearance or smell is clearly abnormal, or if the storage conditions have not been respected. Unless otherwise stated on the packaging, the products must not be frozen.
14. Storage date
The exact storage period is shown on each packaging or each batch.
Depending on the recipe, format, batch, packaging and applicable assessment, the storage indication takes the form provided for by Swiss food law. The customer must refer first to the label of the product received; the general information published on the website does not replace the indications specific to the batch delivered.
15. Production workshop — no on-site sales
The Payerne site is a production workshop. It is not a shop open to the public.
No sale, visit, tasting, order collection or on-site purchase is possible without the express prior agreement of BIONIC. B2C orders are placed online; professional enquiries are handled by direct contact.
16. Customer accounts, credentials and unauthorised access
If the website offers a customer area, the customer is responsible for the confidentiality of their credentials, passwords, means of access and login information.
The customer must immediately inform BIONIC in the event of unauthorised use, suspected hacking, loss of access or unusual activity on their account.
Except for fault attributable to BIONIC, the customer is responsible for orders placed from their account or using their login information. BIONIC may temporarily suspend or block an account in the event of suspected fraud, unauthorised access, compromise or misuse.
If a fraudulent order is placed from a compromised account, BIONIC examines the situation case by case. BIONIC is not responsible for unauthorised access resulting from a failure by the customer to protect their credentials, subject to gross or intentional fault by BIONIC or any other mandatory liability.
17. Warranty and defective products
In the event of an actually defective or non-conforming product, BIONIC offers an appropriate solution after examination: replacement, credit note, full or partial refund, or another measure agreed with the customer.
The warranties do not cover problems resulting in particular from:
- an incorrect or incomplete delivery address;
- an absence or a delay in collecting the parcel;
- inadequate storage after receipt;
- a break in the cold chain after delivery;
- consumption after the date shown;
- incorrect opening or handling;
- use contrary to the product instructions;
- intentional or accidental alteration after delivery.
The customer's mandatory rights regarding defects remain reserved.
18. Liability
BIONIC strives to provide conforming products, reliable information and a serious service.
To the extent permitted by Swiss law, BIONIC's liability is limited to the amount paid for the order concerned.
This limitation does not apply in the event of wilful misconduct, gross negligence, personal injury, product liability, breach of a mandatory provision, or in any other situation where Swiss law prohibits a limitation or exclusion of liability (in particular art. 100 CO).
BIONIC is not liable for indirect damage, loss of profit, commercial losses, loss of data, harm to image, business interruptions or other indirect consequences, except where mandatory provisions state otherwise.
The information published on the website does not replace the customer's obligations regarding storage, handling, checking on receipt and responsible consumption of the products.
19. Food and health claims
BIONIC positions its products as foodstuffs, culinary ingredients and products of taste.
Information relating to fermentation, the living character of the products, the process, the texture, the acidity, the taste, the storage or the culinary use does not constitute medical, therapeutic or individualised nutritional claims.
BIONIC makes no promise to prevent, treat or cure any disease. Anyone with a medical condition, a specific diet, an intolerance, an allergy or a particular health situation should seek advice from a qualified professional before consumption.
20. Intellectual property
The Fermenterie BIONIC® brand, as well as the texts, photographs, logos, graphics, videos, content, visual elements, design and structure of the website are protected.
Except with the prior written authorisation of MealMe Sàrl, any reproduction, modification, adaptation, distribution, extraction, reuse or exploitation, in whole or in part, is prohibited.
21. Personal data
The data processed in connection with orders, payments, deliveries, contacts, customer accounts, B2B forms and the newsletter is processed in accordance with the Privacy policy published on the website, which the customer is invited to consult before ordering.
22. Force majeure
BIONIC cannot be held responsible for a delay or non-performance resulting from an event beyond its control: natural disaster, bad weather, strike, transport problem, major breakdown, supply disruption, administrative decision, health crisis, IT incident, interruption of a provider's service or other case of force majeure. In such a situation, BIONIC informs the customer as far as possible and seeks a reasonable solution.
23. Language of these conditions
These GTC may be published in French, German and English. Each language version is intended for customers who concluded the contract in the corresponding language.
24. Amendment of the GTC
BIONIC may amend these GTC at any time. The applicable version is the one in force at the time the order is validated. Amendments do not affect orders already confirmed, except by agreement or mandatory provision.
25. Applicable law and jurisdiction
These GTC are governed by Swiss law.
For professional customers, any dispute falls within the jurisdiction of the competent courts of the canton of Vaud, subject to an appeal to the Federal Supreme Court and to mandatory provisions to the contrary.
For consumers, the mandatory places of jurisdiction provided for by Swiss law remain reserved.
